Pursuant to section 26 of the Community Charter, the Town of Osoyoos gives notice that it proposes to lease to a business, for the period of May 15, 2013 to September 30, 2013 with a possibility of a further term to be decided by Council, a portion of municipally-owned land at Cottonwood Park in Osoyoos which is legally described as Parcel Identifier: 017-852-536, District Lot 4175S SDYD, as shown on the attached map. One or the other locations identified in red could be used by the successful proponent, but not both simultaneously.
The Town requests proposals to lease the land for Human-Powered Water Sports at Cottonwood Beach requiring shoreline access. Each proposal shall include the lease rate, the intended use of the lands, any improvements that may be put upon the lands, specific dates that lands will be used, and a specified clean up date when the lands will be cleared. Each proposal must meet the following criteria:
- Minimum lease rate of $2,000 for the term, which will be reviewed upon renewal;
- Use must be strictly for water-based activities (non-water-based activities will not be considered);
- Only human-powered watercrafts that can be carried by one person are permitted. Specifically, no use of motorized watercrafts will be permitted;
- No vehicle or trailers on the beach are allowed;
- Tent(s) and other equipment must be removed nightly;
- References are required;
- Liability Insurance in the amount of $3 million is required;
- All Transport Canada certification and licensing must be met and proven for all equipment and staff.
This Request for Proposals is not an Invitation to Tender and no contract of any kind whatsoever is formed under or arises from this Request for Proposals. Proposals will be considered on the basis of bid price, experience of the proponent, and nature of the use of the land. The Town reserves the right to reject any or all proposals; the highest bid will not necessarily be accepted. The Town reserves the right to reject any or all proposals and to accept any proposal the Town considers most favourable to the interests of the Town and the use of the land. Under the Community Charter, the Town must not provide assistance to business and therefore fair market value for use of the land will play a key part in the decision when awarding the lease.
Proposals must be delivered to the Town on or before 12:00 noon Friday, January 11, 2013 in a sealed envelope clearly marked – Cottonwood Lease Proposal to:
